For the last four years or so, I have written and circulated to hundreds of lawyers and judges throughout Florida, periodic emails containing my thoughts on recent developments in the law. Many of them have identified issues in recovering/opposing attorney’s fees, largely because I have found that this important area is regularly under-researched and generally only known in black-letter law snippets. Other memos have focused on common procedural problems in litigation practice, or substantive developments of general importance. This blog [still a work-in-progress] is in response to frequent requests for copies of previous posts that I have made on different topics that may be difficult to research and locate. In time, I plan to transfer the emails/memos from the past years that have continued merit to this blog so that they can be more easily accessed by Judges and lawyers. And finally, when I discuss a new topic and circulate it, I will also post it here so that interested lawyers can discuss and debate my thoughts and opinions more easily. Without a viable place to publish and test one’s opinions and conclusions, lawyers tend to rely on their recollection of what they think the law is, whether accurate or not.
